Terms and Conditions

1. Application

1.1 These conditions govern the contracts for the temporary use of rooms at Eleìra Luxury Accommodation for accommodation and any additional services provided by the property.

2. The Contract

2.1 Offers are not binding on either party. The contract shall be deemed valid only once confirmed by the property manager.

2.2 Unless otherwise agreed, rooms are available on the day of arrival from 3:00 PM (check-in) and must be vacated by 11:00 AM on the day of departure (check-out).

2.3 Eleìra Luxury Accommodation reserves the right to charge a late check-out penalty of €25 for every hour of delay.

3. Prices and Payment

3.1 Eleìra Luxury Accommodation is obliged to make available the rooms booked by the Guest and to deliver the services agreed upon confirmation by the property.

3.2 The Guest is obliged to pay the agreed price for the accommodation and any applicable tourist taxes.

3.3 The agreed prices include value-added tax (VAT).

3.4 Billing is in Euros.

3.5 Upon booking, the Guest shall pay 25% of the total cost of the confirmed services as a confirmatory deposit (caparra confirmatoria).

3.6 The balance must be settled upon arrival at the property (75% of the total cost of services and tourist taxes).

3.7 For late payments, Eleìra Luxury Accommodation is entitled to charge statutory interest pursuant to Art. 1224 of the Italian Civil Code.

3.8 Any complaints regarding the invoice must be reported to Eleìra Luxury Accommodation immediately.

4. Withdrawal by Eleìra

4.1 Eleìra Luxury Accommodation is entitled, for just cause, to withdraw from the contract without liability for damages — for example, where:

• force majeure or other circumstances beyond Eleìra Luxury Accommodation's control render performance of the contract impossible;
• a booking has been made using misleading or false information;
• Eleìra Luxury Accommodation has reasonable grounds to believe that the stay may compromise the smooth operation, safety, or public reputation of the property.

4.2 Eleìra Luxury Accommodation shall inform the Guest of the withdrawal without delay. In the event of justified withdrawal, the Guest shall not be entitled to claim damages.

5. Cancellation, No Show, Early Departure

5.1 Cancellation of a contract must be made via the dedicated form on our website, by telephone, or by email.

5.2 Cancellation:

• For cancellations made up to 72 hours before the stay, the amount paid as a confirmatory deposit shall be retained. In this case, the accommodation contract may be dissolved without the Guest paying a penalty.
• For cancellations made between 72 hours before arrival and the day of arrival, the amount paid as a confirmatory deposit shall be retained. In this case, the accommodation contract may be dissolved with the Guest paying a penalty equal to 25% of the total cost of the confirmed services.
• In the case of a no show (the Guest does not arrive and does not cancel the booking), the amount paid as a confirmatory deposit shall be retained. In this case, the accommodation contract may be dissolved with the Guest paying a penalty equal to 75% of the total cost of the confirmed services.

5.3 In the case of partial cancellations (cancellation of some of the booked rooms or a shortening of the stay), the percentage applies exclusively to the agreed price for the cancelled beds or for the nights that will not be used.

5.4 In the case of late arrival, the full agreed price must nonetheless be paid.

5.5 In the case of early departure, no refund is due for the remaining, unused portion of the stay.

5.6 Pursuant to Art. 59(1)(n) of Legislative Decree 206/2005 (Italian Consumer Code), the 14-day right of withdrawal provided for distance contracts does not apply to contracts for the provision of accommodation for non-residential purposes on a specific date.

6. Liability

6.1 Any claim for damages is excluded unless Eleìra Luxury Accommodation has acted with wilful misconduct.

6.2 Where the Guest is a guest of Eleìra Luxury Accommodation, the property, pursuant to Article 1783 of the Italian Civil Code, is liable for valuables properly stored in the in-room safe. Such liability is limited to the value of items damaged, destroyed, or taken, up to the equivalent of one hundred times the daily room rate.

6.3 We accept no liability for the loss, theft, or damage of items belonging to you left unattended in the rooms.

6.4 Please provide, upon booking or upon arrival at the property, any information regarding intolerances and allergies. Eleìra Luxury Accommodation declines any liability arising from missing or incomplete information.

6.5 If a guest causes damage to the room or to any other area of the property during the stay, the person who made the booking shall be liable for the resulting damages. If the room or any other area of the property is left damaged or heavily soiled, or if items are found to be missing or to have been removed from the property, Eleìra Luxury Accommodation reserves the right to charge the associated costs to the credit card of the person who made the booking.

7. House Rules

• Quiet hours / children. Complete silence must be observed between 10:00 PM and 7:00 AM. Children must always be accompanied by an adult. In any event, conduct must at no time and in no way disturb the peace of others.
• Housekeeping. Rooms are serviced daily. Rooms must be vacated between 10:30 AM and 2:30 PM. Otherwise, housekeeping will be postponed to the following day. Please arrange your personal effects so as to allow the cleaning to take place.
• Other Guests. It is strictly forbidden to bring other persons into the room or any area of the B&B without the manager's authorisation, subject to a surcharge of €50. The Guest may not sublet or lend, in whole or in part, the room, under penalty of termination of the booking and a contractual penalty of €1,500.
• Breakfast. Breakfast is served between 8:30 AM and 10:30 AM.
• Smoking / weapons / drugs. It is strictly forbidden to bring in weapons, narcotic substances, or anything of the sort — under penalty of immediate termination of the contract. Smoking in the rooms is likewise strictly forbidden. You may freely smoke on the balcony, using only the ashtrays provided there.
• Personal Belongings. Items of any kind may not be left in corridors or common areas. The B&B is not responsible for personal belongings left unattended. Please store your valuables in the safes provided in the rooms.
• Pets. It is strictly forbidden to bring animals of any kind or size.
• Decency. It is strictly forbidden to move about the B&B in clothing that may offend the modesty of others, and in any event the Guest is prohibited from acts or conduct that may disturb the other occupants of the building.
• Bathrooms. Please use the bathroom facilities in a proper and civil manner and dispose of items in the bins provided.
• Please notify us of any intolerances or allergies. Eleìra Luxury Accommodation declines any liability arising from missing or incomplete information.

8. Governing Law and Jurisdiction

8.1 This contract is governed by Italian law.

8.2 Any dispute regarding the interpretation, performance, or termination of this contract shall fall under the exclusive jurisdiction of the Court of Alba (CN).

8.3 Pursuant to EU Regulation No. 524/2013, we inform the consumer that, in the event of a dispute, they may submit a complaint via the European Union's ODR platform, available at: <a href="https://ec.europa.eu/consumers/odr" target="_blank" class="underline">ec.europa.eu/consumers/odr</a>.
